New regulations on temporary employment as of 1 April 2017.

In the future, the law imposes an 18-month limitation on the maximum loan period to a client within the framework of a mandate. Afterwards the client has to present an offer for take-over. Alternatively, the employee must be deployed at another client; a further deployment at the same client is only permissible upon expiry of a period of at least 3 months and 1 day.

The temporary employee may decide to continue the contractual relationship with the lending employer by filing a declaration of continuation, which has to be handed in personally at an employment office by the expiry of a period of one month following the exceeding of the maximum loan period. Such declaration then has to be presented to the lending or user employer within three days.
